1. Legal Entity & Platform Identification

These Terms and Conditions (“Terms”) govern access to and use of the SHRTSTAYS booking platform available at https://tangier.shrtstays.com (the “Platform”).

The Platform is owned and operated by:

TRYB International, LLC

Registered in Newark, Delaware, United States

(“SHRTSTAYS”, “we”, “us”, or “our”)

SHRTSTAYS operates a short-term and vacation rental booking platform for properties located primarily in Tangier, Morocco.

By accessing the Platform, making a reservation, or completing a booking, the user (“Guest”, “you”, or “your”) expressly acknowledges, accepts, and agrees to be legally bound by these Terms without limitation or reservation.

2. Binding Nature of Acceptance

Acceptance of these Terms occurs when the Guest:

• Clicks “Book”, “Confirm”, or any equivalent action, or

• Completes a payment or reservation, or

• Attempts to check in to a property booked through SHRTSTAYS.

Such acceptance constitutes a legally binding contract, enforceable under applicable laws in Morocco, the United States, and internationally.

3. Eligibility & Legal Compliance (Morocco)

3.1 Moroccan Penal Code – Article 490

The Guest is explicitly informed that Article 490 of the Moroccan Penal Code criminalizes sexual relations between unmarried persons of Moroccan nationality or where one party is Moroccan, outside of a legally recognized marriage.

As a result:

• Unmarried Moroccan couples, or couples where one party is Moroccan, must present a valid marriage certificate at check-in if sharing the same accommodation.

3.2 Mandatory Documentation

At check-in, SHRTSTAYS may require:

• Valid government-issued identification

• Marriage certificate (where applicable)

• Any legally required accommodation registration documentation

Failure to comply constitutes a material breach of these Terms.

4. No-Refund Policy for Legal Non-Compliance

If Guests:

• Arrive without a required marriage certificate, or

• Are denied accommodation due to Moroccan law or local authority requirements,

NO REFUND SHALL BE ISSUED UNDER ANY CIRCUMSTANCES, including but not limited to:

• Accommodation cost

• Service fees

• Taxes

• Any ancillary charges

By accepting these Terms, the Guest:

• Explicitly waives any right to a refund

• Agrees not to file a chargeback, dispute, claim, or complaint with any bank, card issuer, payment processor, or platform

This clause is fundamental and non-negotiable.

5. Security Deposit – Mandatory Pre-Authorization

5.1 Amount & Cardholder Requirement

A mandatory security deposit of €150 (one hundred fifty euros) shall be pre-authorized on the payment card on file before check-in.

Conditions:

• The card must be in the name of the main Guest

• Third-party cards may be refused at SHRTSTAYS’ sole discretion

5.2 Failure to Pre-Authorize

If the €150 deposit cannot be pre-authorized for any reason:

• Check-in shall be refused

• No refund shall be issued

• The Guest expressly accepts the refusal without dispute

The Guest waives all rights to:

• Chargebacks

• Bank disputes

• Payment processor claims

• Platform mediation requests

6. Use of Security Deposit – Damages & Theft

The security deposit covers, without limitation:

• Physical damages to the room or property

• Missing items

• Theft

• Excessive cleaning

• Property misuse or negligence

6.1 Damages Exceeding €150

If damages, losses, or theft exceed €150, the Guest:

• Authorizes SHRTSTAYS to charge the full and exact amount to the card on file

• Accepts full financial responsibility for all damages caused by themselves or their guests

• Agrees to claim reimbursement through their travel insurance, where applicable

6.2 Chargeback Waiver

The Guest irrevocably agrees:

• Not to initiate any chargeback or dispute related to damage or theft charges

• Not to contest charges arising from property damage assessments

Any chargeback attempt shall be deemed a breach of contract and may result in legal recovery actions.

6.3 Proof of Repairs

If requested, the Guest may obtain:

• A scanned copy of repair or replacement invoices

• Upon written request to SHRTSTAYS support

Provision of invoices does not invalidate or delay payment obligations.

7. Payments & Third-Party Processors

Payments are processed via third-party providers including Stripe.

SHRTSTAYS:

• Does not store full payment card details

• Is not responsible for banking errors, authorization failures, or processor delays

8. Refusal of Service

SHRTSTAYS reserves the absolute right to:

• Refuse check-in

• Terminate a stay

• Cancel access to the property

Without refund, in cases including but not limited to:

• Legal non-compliance

• False declarations

• Fraud

• Damage risk

• Violation of Moroccan law

• Violation of these Terms

9. Limitation of Liability

To the fullest extent permitted by law:

• SHRTSTAYS and TRYB International, LLC shall not be liable for indirect, incidental, or consequential damages

• Liability is strictly limited to the amount paid for the reservation, excluding damages and penalties

10. Indemnification

The Guest agrees to fully indemnify and hold harmless SHRTSTAYS, TRYB International, LLC, property owners, and partners from:

• Legal claims

• Fines

• Penalties

• Losses arising from the Guest’s actions or violations

11. Governing Law & Jurisdiction

These Terms are governed by:

• The laws of the State of Delaware, USA

Without prejudice to:

• Mandatory Moroccan public-order laws applicable to accommodation and penal compliance

Exclusive jurisdiction shall lie with courts determined by SHRTSTAYS, to the extent legally permissible.

12. Severability

If any provision is held invalid or unenforceable:

• Remaining provisions shall remain fully valid and enforceable

13. Entire Agreement

These Terms constitute the entire agreement between the Guest and SHRTSTAYS and supersede all prior communications.
